Terms & Conditions.
1. Definitions
1. The ‘Photographer’, ‘Us’, ‘We’ refers to Only4thebrave Photography.
2. The ‘Client’ refers to ‘Your’, ‘You’ the individual or organisation who hires the photographer from Only4thebrave Photography on a freelance basis.
3. ‘Image’ and ‘Photographs’ refer to all photographic production by Only4thebrave Photography.
2. Copyright and Ownership of Materials
The entire copyright, title, and intellectual property rights of any Images will always remain that of The Photographer throughout the world.
3. Right to a Credit
The Photographer asserts both his moral right to be identified as the author of his work and the right to a credit (where possible) is asserted in accordance with Sections 77 – 79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof. Please credit ‘Only4thebrave’.
3.1 Use
Images are to be used as agreed at the time of booking and at the time of agreeing the fee. The licence to use is limited to the use and period specified on The Photographers booking form and no other use may be made of the Images without the Photographers express permission. An agreement must be reached with The Photographer before Images are used for any other purpose or after the licence to use has expired.
1. Manipulation of the Images or use of only a portion of Image may only take place with the permission of the Photographer.
2. When the license to use has expired an additional charge has to be agreed for extended usage with the Photographer.
3.2 Exclusivity
1. The usage rights granted are personal to the Client and may not be assigned, nor may any image submitted to the Client be loaned or transferred to third parties (save for the purpose of the work by the Client of such reproduction/usage rights/PR).
2. The Photographer reserves the right to refuse to supply or grant a reproduction licence to a third party when requested to do so by the Client.
3. The Photographer retains the right in all cases to use the Images covered by this agreement at any time and in any part of the world for the purposes of advertising or otherwise promoting his work.
4. Client confidentiality
The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him, save as to be reasonably necessary to enable the Photographer to carry out his obligations in relation to the work.
5. Booking Fees and Refunds
1. A booking fee of £50 is payable at the time of booking, this can be made online via PayPal.
2. Upon receipt and acceptance of a signed copy of this agreement and payment of the mentioned booking fee is cleared, Only4thebrave Photography will secure the time and date agreed for the event(s) and day(s) mentioned on your booking application.
3. The booking fee is non-refundable and non-transferable in the event of cancellation by you the Client.
4. The booking fee is credited towards the total amount quoted for the event and or services offered which is non-refundable except in any situation where the Photographer(s) cancels this agreement or is unable to perform. (Please also see ‘Limitation of Liability and Indemnification’ and ‘Cancellation’, below).
5. ‘Only4thebrave Photography’ will not refund any monies once the event has taken place. In exceptional circumstances should the digital files and or equipment are lost, stolen or destroyed or due to a photographic or mechanical failure i.e. images are lost through equipment malfunction, camera damage or otherwise lost, stolen or damaged without fault on the part of the Client and ‘Only4thebrave Photography’ and only when no photos have been produced will entitle the Client a full refund.
6. Once the Client has made a booking for a specific time and date and this date/time has been Confirmed by The Photographer, The Photographer will not accept any other work from other clients for those times and dates.
6. Cancellation or Postponement by the Client
1. When a booking is Confirmed, if it is subsequently cancelled, a cancellation fee will be charged to the client according to the following schedule: (i) When a client cancels photography within less than 7 days business of any confirmed date, a fee of 20% of the booked time rate will be charged. (ii)
2. When a client cancels photography within less than 24 hours of any confirmed date/time, a fee of 50% of the booked time rate will be charged. (iii) When a client cancels photography on the day of the confirmed date, the full fee will be charged.
3. When a booking is confirmed, if it is subsequently postponed, the Photographer will at his discretion charge a fee for postponement.
4. In addition, the client may be charged for any expenses incurred by The Photographer because of cancellation or postponement.
7. Cancellation by the Photographer
The Photographer will endeavour to put the Client in touch with another photographer in the event The Photographer is unable to attend on booked date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of such cancellation by The Photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid to the Photographer by the Client at that time.
8. Rejection
Unless a rejection fee is agreed in advance, there is no right to reject the Images based on style or composition.
9. Charges and Timings
1. If The Photographer provides a quote to The Client, the fee will be charged at that agreed rate. The Photographer generally requests a brief at the time of booking (via email or verbally).
2. Where extra expenses or time are incurred or needed by the Photographer because of alterations to the original brief by the Client or otherwise at their request, the Photographer will reserve the right to charge the Client extra expenses and fees.
3. If The Client changes the length of the job, the fee will increase as per the agreed hourly rate. If The Client is delayed or running late and the job runs into extra time again the fee will increase as per the agreed hourly rate. The Photographer will make The Client aware of timings and should the work run into extra time he will make the client aware of this and the associated costs. There is a mutual understanding between The Client and The Photographer that punctuality is important and respected by all parties.
4. If it becomes apparent when the job starts that it is much bigger or different job to the agreed brief it will be made clear to the Client that The Photographer’s fee may increase. If the Photographer is unable to contact the client/payer of invoice at that time work will stop until contact has been made.
5. On the occasion that incorrect information is given by the Client regarding a booking (wrong location, wrong time etc.) or the Client fails to arrive at the agreed location/time, the full fee will be charged to the Client.
6. If on arrival at a booked job there is an issue (outside of the Client or Photographer’s control) such as bad lighting or restrictions are in use of where the shoot is taking place, a fee may be charged to cover time.
7. Quoted fees include mileage up to 80 miles round trip. Additional mileage will be charged at 45 pence per mile thereafter.
8. Any congestion charges, road toll charges and parking costs will be billed to the client as a Photographer expense and will be added onto the invoice.
9.2 Travel Subsistence and Expenses
1. For attendance at venues outside of West Midlands and Central London Zones 1-2 (refer to Transport for London Underground Zones); travel costs beyond these areas are chargeable and will need to be paid in advanced by the client before the date of the event or arrange necessary transport for the Photographer(s). This is usually included in the final price quoted to you.
2. Where the Photographer(s) is required to travel outside the agreed venue(s) on your booking application form, this will be chargeable separately to the client at the Photographer(s) discretion.
3. Where the event requires an overnight or longer stay, whether in the UK or abroad, hotel and travel expenses is to be fulfilled by the client or the appropriate sums paid in full to the Photographer(s) in advance of the event allowing enough time to book relevant dates, modes of transport and the booking of accommodation.
4. The Client shall reimburse the Photographer(s) for any additional expenses occurred to the Photographer(s) for which the Client is liable; and for any other adverse costs expected or unexpected as necessary in fulfilling the services mentioned unless otherwise directed by the Client.
10. Images
1. You will receive images either on Online Download CD / DVD, USB
2. All final image sizes are nominal.
3. The Photographer will colour balance all photographs which they deem to be appropriate but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres and or anomalous lights. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.
4. Digital proofs will be ready approximately within 4 to 12 days after the date of the event(s).
5. ‘Only4thebrave Photography’ is not liable to provide every image taken at the event. The determination of images delivered to the Client is left to the discretion of the only4thebrave Photography.
6. ‘Only4thebrave Photography’ will maintain backup copies of the images in archives for a period of 1 year at which time the client may request all original JPEG files on CD, DVD or USB at an additional cost of £100 including Postage and Packaging.
7. There is no minimum or maximum number of images you will receive.
11. Photography
1. The Photographer(s) will document your event in a candid documentary style and will choreograph shots at their will.
2. You the Client will be responsible for appointing an events manager who will be responsible in bringing any specific shots i.e. formal shots of family members etc to the attention of the Photographer(s).
3. Prior to and or during the event, you may inform the Photographer(s) of any subjects or styles in which you would like the event photographed.
4. Only4thebrave Photography will try it’s best to honour your requests however we cannot guarantee that all or any of your requests will be met. The final content of the images produced is at the discretion of the Photographer(s).
12. Creative License
1. ‘Only4thebrave Photography’ shall be granted artistic licence in relation to the poses photographed and the locations used.
2. The style and the number of photographs are also dependent on vagaries of the weather and the availability and willingness of the clients and their guests.
3. The Photographer(s) will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.
13. Buy Now Pay Later – Payment Plan
1. The ‘Buy Now Pay Later’ applies if you have specifically taken out this package.
2. If your event is 5 hours, 10 hours or 15 hours etc long, we will quote you a price based on the hours we will be photographing.
3. if your event is in London you will be required to pay a minimum of pay £300* deposit and clear the remainder of your balance when you’re ready to receive all the photos.
4. You will need to pay a minimum booking fee of £300 to secure your Buy Now Pay Later booking.
5. You will receive all your completed photographs after you have cleared the balance in full for your package.
6. The Buy Now Pay Later scheme is an interest free offer. We do not charge nor deal with interest.
7. The Buy Now Pay Late scheme is not a finance offer, no finance or credit checks are carried out.
8. The rate and the service from this offer is no different from any other rates or services offered on our website,
9. The £300 ‘Buy now Pay later’ starts from a minimum of 5 hours of photography in London.
14. Limitation of Liability and Indemnification
In the unlikely event the digital files and or equipment are lost, stolen or destroyed or due to a photographic or mechanical failure i.e. images are lost through equipment malfunction, camera damage or otherwise lost, stolen or damaged without fault on the part of the Photographer(s) and or cancellation of this agreement by either party or in any other circumstance; the liability of ‘Only4thebrave Photography’ shall be limited. ‘Only4thebrave Photography’ will not be liable for any direct, indirect or any consequential loss and will be free from any damages, claims or lawsuits brought against the Photographer(s) or Only4thebrave Photography.
1. Client shall indemnify and hold Photographer(s) harmless from and against any claims made by any other person or entity resulting from the presence and performance of Photographer(s) services under this agreement.
2. The Client agrees that this entire event cannot be replicated, re-enacted or repeated for the purpose of a re-shoot, and limits the Photographer’s liability to refund the full amount paid under this agreement.
3. Client shall indemnify and hold ‘Only4thebrave Photography’ harmless from any loss, damage or liability resulting from the Client’s violation of the terms of this Agreement or any agreement involving Client and the Photographer(s).
15. Complaints
Any complaints should first be raised by the Client with Only4thebrave Photography in writing within 5 working days from the date of receipt of the images. Any complaints made after 5 working days from the receipt of the images will be void.
16. Independent Contractor
This agreement is not to be construed as an employment Contract in any way; ‘Only4thebrave Photography’ functions as an independent contractor and the Photographer(s) are freelancers.
